Preamble

SAWASDEE DIVERS KRABI is a diving center offering any activity related to scuba diving, with or without scuba diving.

Its registered office is 259 Moo 4, Ao Nang, Mueang Krabi, district of Krabi 81180
it is registered in the Commercial Register of Thailand under the number 81‑0005425‑8

The privileged place of the activity and the reception of the customers is located 259 Moo 4, Ao Nang, Mueang Krabi, district of Krabi 81180.

For the application of these general conditions of sale and service – (hereinafter referred to as the “GTC”), it is agreed that Sawasdee Divers Krabi and the persons ordering the Service(s), will be collectively referred to as the “Parties” and individually referred to as the or a “Party”, and more specifically for Sawasdee Divers Krabi
“Sawasdee Divers Krabi” or the “Seller”, and for those who have placed an order, the “Buyer” or the “Customer”.

Article 1. Object

SAWASDEE DIVERS KRABI hereby defines the T&Cs which are applicable to all commercial relations between the Seller and the Customers (individuals and groups).
The T&Cs apply to the exclusion of any other document.

A version of the general terms and conditions of sale is available on the SAWASDEE DIVERS KRABI website (https://www.sawasdee-divers.com) when the Customer makes his reservation request for diving services with the center. Any reservation request with SAWASDEE DIVERS KRABI implies acceptance of these general conditions of sale.

Any order for a Service implies the Buyer’s adherence to these GCS, without reservation, restriction or condition, and thereby declares to have read the contraindications to scuba diving and to be fit for its practice.

SAWASDEE DIVERS KRABI reserves the right to modify at any time, in whole or in part, the GCS by publishing a new version on its website, it being specified that the applicable GCS are those in force on the date of the order.

A minor diver must be in possession of a parental authorization allowing him to dive in exploration or to carry out a diving or first aid training with SAWASDEE DIVERS KRABI.

Article 2. Services


2.1 Availability


Only the Services appearing on the Website or on the legal notice boards on site on the day of their consultation by the Buyer are offered for sale by SAWASDEE DIVERS KRABI. The offers concerning the Products and Services are valid, within the limits of available stocks or opening dates, as long as they are visible or offered on the Website or the said panels.

The photographs, images or other reproductions presented on the Website as an illustration of the Services offered are not contractual. The Purchaser is invited to consult the description of each Service to find out about its availability, characteristics and, where applicable, any other information relating to its conditions of use or use.

The information relating to the Products and Services is likely to be modified by SAWASDEE DIVERS KRABI, at any time, and may be subject to updating, in particular concerning availability, between the moment the Buyer becomes aware of it and its order.

SAWASDEE DIVERS KRABI makes every effort to ensure the accuracy of the information presented on the Website regardless of its form and content. However, in the event of a difference noted, in particular on prices, between the Website and the legal display on site, the information retained will be that displayed or available on site at the dive center.


2.2 Exploration Dives

The price of the exploration dive includes:

  • Transport to and from the hotel if it is in the Ao Nang area
  • Transport to the dive site by boat,
  • The supply of the equipment necessary for the dive
  • The supply of the inflated bottle
  • The services of the instructor for the dives
  • Drinks and lunch on the boat

The price of the exploration dive does not include:

  • Insurance
  • Entrance to the marine national park (600 THB per person)

2.3 Discovery package and snorkeling


The price of “Discovery” packs includes:

  • Transport to and from the hotel if it is in the Ao Nang area
  • Transport to the dive site by boat,
  • The supply of the equipment necessary for the dive
  • The supply of the inflated bottle
  • The services of the instructor for the dives
  • Drinks and lunch on the boat
  • Insurance

Prices do not include:

  • Entrance to the marine national park (600 THB per person for divers and 400 THB for snorkelers)

The price for snorkeling includes:

  • Transport to and from the hotel if it is in the Ao Nang area
  • Transport to the dive site by boat
  • The supply of the wetsuit or shorty, fins, mask and snorkel
  • Rental of instructor services for supervised hikes
  • Drinks and lunch on the boat

Prices do not include:

  • Entrance to the marine national park (600 THB per person for divers and 400 THB for snorkelers)
  • Insurance

2.4 Training

The price of PADI training includes:

  • Transport to and from the hotel if it is in the Ao Nang area
  • Transport to the dive site by boat,
  • The supply of the equipment necessary for diving (wetsuit, mask, fins, vest, regulator with octopus, belt and ballast)
  • The supply of the inflated bottle
  • The services of the instructor for the dives
  • Drinks and lunch on the boat
  • Insurance for PADI Open Water courses
  • PADI certification digital card
  • The dive log
  • The digital training manual

2.5 Location of the activity

The dives as well as the practical and theoretical training take place at (or from) the address of the dive center.

However, SAWASDEE DIVERS KRABI reserves the right to change the location of the activity if necessary.

2.6 Activity times

The activity takes place, in general and unless otherwise specified:

  • For local islands: boat departure 08:00, return 14:00
  • For Phi Phi Islands: boat departs 8:00 a.m., returns 5:30 p.m.

However, SAWASDEE DIVERS KRABI reserves the right to modify the schedules of the activity if necessary.

Any delay by the Customer cannot result in a significant shift in activity.

In the event that the Customer does not show up on the day of the reserved diving service or at the fixed time, SAWASDEE DIVERS KRABI reserves the right to retain the total amount of the service paid by the Customer.

2.7 Customer Obligations

The Client must personally ensure that he is in possession of all the qualifications and supporting documents required for the activity he wishes to perform and produce the originals to SAWASDEE DIVERS KRABI before the start of these activities.

Especially when they are required: patent, qualification, licenses, medical certificate.

2.8 Validation of a diving level or first aid training

The validation of a diving level is sanctioned by the satisfaction of practical and/or theoretical skills. SAWASDEE DIVERS KRABI reserves the right not to issue a diving or first aid level if the Client has not reached the minimum skills relating to the level claimed by the training and in accordance with PADI standards. This case cannot give rise to any refund.

Article 3. Price

All prices displayed are expressed in Thai Baht (THB). The valid prices are those in force at the time of the reservation made by the Customer. The Seller reserves the right to modify these prices at any time, in whole or in part.

Article 4. Reservation

The Customer’s reservation will only be definitively recorded upon receipt of a deposit of 50% of the total amount.

The balance must have been paid no later than 24 hours before the diving service.
Full payment will be requested for reservations taking place less than 24 hours before the dive service.

From the registration of the reservation, a confirmation e-mail from the Seller will be sent to the Customer, specifying the dates of the services.

The Seller reserves the right to refuse any reservation from a Customer with whom there is a dispute.

For the follow-up of the reservations, SAWASDEE DIVERS KRABI sends by email a confirmation of good reception of the reservation and the reception of the deposit, and makes available to the Buyer, either the electronic address: info@sawasdee-com, or the number 00 66 (0) 6 55 399 770.

Article 5. Payment and ownership

5.1 Payment

Payment of the price and other fees or taxes is made in Thai Baht and for the full amount corresponding to the orders.

The payment of the deposit must be made by:

  • Bank cards (3% fee),
  • PAYPAL payment (4.5% fee),
  • Bank transfer to be made to the bank account of SAWASDEE DIVERS KRABI,
  • Cash

5.2 Retention of title clause

Regarding training: notwithstanding any clause or provision to the contrary, the Seller has a right of reservation allowing him to refuse to issue a certification until full payment to him of the payment of his price, fees and taxes. reporting thereon as appropriate. The issuance of the certification for the benefit of the Buyer will only take place after this payment.

Article 6. Cancellation, postponement, interruption of the diving service

6.1 By the Customer

Any dive booked by any means is due, unless canceled by SAWASDEE DIVERS KRABI. The invoicing of the services offered by SAWASDEE DIVERS KRABI is made on the basis of the reservation, unless effective cancellation within the time limits provided for in the following paragraph.

A deposit of 50% of the total amount must be paid for the reservation to be fully confirmed.

This deposit is non-refundable in the event of cancellation less than 24 hours before the scheduled departure time of the diving activities or courses.

The remaining 50% must be paid in full to Sawasdee Divers Krabi the day before the dive activities or lessons.

For the proper management of places, in particular on board its boats, in the event of cancellation reported less than 24 hours before the start of the service, this will be due in full and all the sums already paid by the Customer will remain acquired at SAWASDEE DIVERS KRABI.

In the event of cancellation reported more than 48 hours before the start of the service, SAWASDEE DIVERS KRABI may, as far as possible, offer another date to the Customer so that he can carry out the reserved service. If it is impossible for the Customer to change the date, all the sums already paid by the Customer will be reimbursed by SAWASDEE DIVERS KRABI.

Any activity started will not give rise to any refund, if the cancellation is due to the Customer (personal convenience, ear problem, stress or any reason whatsoever).
Regarding training, SAWASDEE DIVERS KRABI would not incur any liability if, for personal reasons, the Client had to interrupt the training, or if the Client did not show up at the place or on the scheduled date. In particular, the sums already paid would remain acquired by SAWASDEE DIVERS KRABI and all the costs incurred would remain the responsibility of the Customer.

Consequently, SAWASDEE DIVERS KRABI advises its Customers to take out cancellation insurance with a competent body.

6.2. By SAWASDEE DIVERS KRABI

A diving service may be canceled by SAWASDEE DIVERS KRABI for meteorological or technical reasons.

In the event of cancellation for weather reasons, SAWASDEE DIVERS KRABI may propose the postponement of the service to another more favorable date, within the limits of available places. If the Customer is unable to postpone the services (length of stay too short), SAWASDEE DIVERS KRABI undertakes to reimburse the amount of the services not provided.

In the event of cancellation for technical reasons, SAWASDEE DIVERS KRABI may propose the postponement of the service to another more favorable date, within the limits of available places. If the Customer is unable to postpone the services (length of stay too short), SAWASDEE DIVERS KRABI undertakes to reimburse the amount of the services not provided.

In all these cases of unforeseeable circumstances or events, the additional costs resulting from the partial postponement, the total postponement or the extension of the stay remain the responsibility of the Customer.

Article 7. Responsibilities

The Client is automatically covered in civil liability during the sessions and the dives organized by SAWASDEE DIVERS KRABI due to the insurance contracted by the company.

For exploration dives, the Customer is advised to take out additional insurance (bodily injury and material damage) to practice the activity of scuba diving,

The customer is also advised to take out cancellation insurance with an authorized organization.

Article 8. Security and personal effects

SAWASDEE DIVERS KRABI can in no way be held responsible for objects deposited or entrusted to the diving center. In particular, SAWASDEE DIVERS KRABI cannot be held responsible for the theft or loss of personal property in the diving center or during the diving service.

Article 9. Miscellaneous provisions

9.1 Force Majeure

SAWASDEE DIVERS KRABI will not be responsible for the total or partial non-execution of its obligations under the sales contract resulting from a validated order, if this non-execution is caused by an event constituting Force Majeure, as usually retained according to the criteria defined by the case law of the Thai courts, and in particular in the event of disruption or total or partial strike affecting the postal services and means of transport and/or communication, flood, fire or other events of a natural disaster nature.

SAWASDEE DIVERS KRABI will notify the Buyer of an event constituting force majeure, within 10 working days of its occurrence.

The Parties agree to consult together as soon as possible in order to determine the terms and conditions for processing the order for the duration of the case of Force Majeure.

Beyond a period of (one) 1 month of interruption due to Force Majeure, the Parties will be released from their obligations to each other. If necessary, SAWASDEE DIVERS KRABI will reimburse the Buyer as soon as possible.
